CC approved Deshabandu as IGP constitutionally – Speaker

Speaker Mahinda Yapa Abeywardena stated in Parliament yesterday (26) that the Constitutional Council (CC) did not engage in any wrongful process when approving the appointment of Deshabandu Tennakoon as the Inspector General of Police (IGP).

The Speaker emphasized that the name was approved constitutionally, correctly, and with a clear conscience, ensuring attention to every detail.

He further explained that removing a person appointed by the Constitutional Council requires following a specific procedure outlined in the law. He referred to Article 41(c) of the Constitution, which details this process, underscoring that without this process, there is no possibility of removing an appointee of the Executive as recommended by the Constitutional Council.

Speaker Abeywardena made these comments while presenting his views in Parliament on the current situation regarding the IGP’s position.

He noted that under the current circumstances, even the President is unable to make a decision on this matter. He further mentioned that any individual could approach the courts for a review if necessary.

Additionally, the Speaker addressed the Parliament stating:”A multitude of questions have been raised concerning this issue.The most significant accusation is that this situation arose due to an incorrect decision made by me under the Constitution.We have not made any incorrect decisions. Every decision was made constitutionally, correctly, and after thorough consideration. This decision might seem wrong to you or others, but it was made with a clear conscience and proper attention to all matters. We have acted under the Constitution and made this decision after careful thought.

“There was a claim that I made this decision from home, which is false.

I acted according to Article 41E and used the voting process. No matter what you say, there was no problem or issue. “We made the right decisions. The current situation with the IGP is different. The IGP’s service is suspended. I must say that under Article 41E and C, the Constitutional Council approved his appointment and the Parliament agreed. There is a separate provision for officials under Article 41C. If a position under 41C is vacated, there is a specific procedure, as mentioned by the Leader of the House. It must be done accordingly. Even the President cannot make this decision now. If I am wrong, you can correct it through the courts.”
