Data linked to the mobile phone of the late former SriLankan Airlines Chief Executive Officer Kapila Chandrasena, who died under mysterious circumstances, could be at risk of being lost after November 29, following a notification from Apple regarding its 90-day data retention period.
The Colombo Crime Division (CCD) informed the Fort Magistrate’s Court on Wednesday (14) that a court order had been forwarded to Apple through the Ministry of Justice under the Mutual Legal Assistance (MLA) process to obtain data from Chandrasena’s mobile phone.
However, Apple had reportedly informed investigators that the relevant data would be retained for only 90 days.
Fort Magistrate Pasan Amarasena, noting that the 90-day period would expire on November 29, questioned whether the data would be lost after the deadline.
Investigating officers informed the court that a further request had been made to Apple, but no response had been received so far.
Expressing dissatisfaction with the progress of the investigation, the Magistrate questioned why the Inspector General of Police (IGP) or the Attorney General (AG) had not been informed about the difficulties in obtaining potentially crucial evidence.
The Magistrate subsequently ordered the CCD to immediately inform the IGP and the Attorney General about the requests made to Apple and take necessary further action.
Meanwhile, the CCD informed the court that the Government Analyst’s reports concerning four types of medication recovered from the location where Chandrasena died had not yet been received, although other reports had been submitted.
The Magistrate observed that Chandrasena had died on May 8 and that the examination of evidence had been completed within a month, yet the relevant Government Analyst’s reports remained pending.
He further remarked that the court alone could not carry out the entire process.
The CCD informed the court that the Government Analyst’s Department had notified investigators on October 13 that another three weeks would be required to provide the outstanding reports relating to the medications. (Newswire)
