SLFP petition – order fixed for today before CDC on maintainability of case

A case was filed before Colombo District Court (CDC) seeking an order preventing others from disrupting the functions of Sri Lanka Freedom Party (SLFP) Acting Chairman Nimal Siripala de Silva and SLFP Acting General Secretary Duminda Dissanayake, was yesterday fixed for today (15) to deliver the order regarding the maintainability of the case.

The case was taken up before Colombo Chief District Judge Sandun Vithana.

When the case was taken up before the Court the defence informed the Court that the Kaduwela District Court has issued an injunction order on May 13, preventing any party from disrupting the functions of the newly appointed Chairman Dr. Wijeyadasa Rajapakshe and Acting General Secretary Keerthi Udawatta.

The Petition emphasises that although the respondents had appointed Wijyadasa Rajapakshe as the Chairman of the Sri Lanka Freedom Party in a meeting which was called a meeting of the Executive Council of the Sri Lanka Freedom Party held on May 12, that meeting was not a legal and valid meeting.

In his petition, the petitioner sought from the Court to issue an order preventing others from interfering with the party’s affairs of petitioner Duminda Dissanayake, who is the Acting General Secretary of the Sri Lanka Freedom Party, and an interim restraining order preventing the decisions taken at the so-called meeting in which second defendant Wijeyadasa Rajapakshe was appointed as the President of the SLFP and third defendant Keerthi Udawatta was appointed as the Acting General Secretary of the SLFP. After considering the facts, the case was fixed for today to deliver the order regarding the maintainability of the case by the Colombo District Court.

The petition was filed by SLFP General Secretary Duminda Dissanayake and the petition has cited SLFP Deputy Chief Secretary Sarath Ekanayake, SLFP Chairman President’s Counsel Dr. Wijeyadasa Rajapakshe, SLFP Acting General Secretary Keerthi Udawatta, SLFP Acting Chairman Nimal Siripala de Silva and SLFP Senior Deputy Chairman Mahinda Amaraweera as the respondents.

President’s Counsel Chandaka Jayasundara appeared for the plaintiff while President’s Counsel Romesh de Silva, Attorneys Shaheed Barrie and Pulasthi Rupasinghe appeared for the defence.
