Ministers Harin Fernando and Manusha Nanayakkara yesterday filed Fundamental Rights petitions in the Supreme Court seeking to quash the decision taken by the Samagi Jana Balawegaya to abolish their Party memberships and the Parliamentary seats.
Nine persons including SJB General Secretary Ranjith Maddumabandara, Chairman Sajith Premadasa, Secretary General of Parliament and the Elections Commission Chairman have been cited as respondents in these petitions.
The petitioners cited that they contested the last Parliamentary election under the SJB ticket and they were elected to Parliament. These two Minister had informed the Court that they later supported the Government.
The petitioners said that they received several letters from the SJB General Secretary from May 2022 citing that the party is taking disciplinary action against them.
They said in their petition that executive committee of the Samagi Jana Balawegaya has not been appointed in compliance with the Constitution of the Party and this fact has been mentioned in the complaint filed in the Supreme Court by State Minister Diana Gamage against the abolition of her membership of the SJB.
Petitioners Harin Fernado and Manusha Nanayakkara cited that neither the SJB Chairman Sajith Premadasa nor the SJB General Secretary have any authority to take disciplinary action against him due to this situation.
They said that they received letters from the SJB General Secretary that their Party membership has been abolished after being found guilty for breaching the party discipline.The petitioners seek Supreme Court declaration that they would not loose their parliamentary seats through the letter issued by the SJB General Secretary.
