The Court of Appeal issued an interim restraining order yesterday (24) suspending the trial filed against former minister Patali Champika Ranawaka at the Colombo High Court, under four charges including causing serious injury to a youth in Rajagiriya area by reckless driving in 2016.
This order was issued after considering the basic facts regarding the revision petition submitted by the former minister Patali Champika Ranawaka, requesting to suspend the hearing of the case filed before the Colombo High Court.
This order was declared by the presiding judge Nishshanka Bandula Karunaratne of the Court of Appeal Judge with the concurrence of Judge M. C. B. S. Moraes.
The decision of the Attorney General to file two cases against the petitioner on the same charge was determined to be a legal issue and the relevant interim order was issued.
The relevant interim order shall remain in force till the hearing of the petition is completed. The hearing of the petition was scheduled to begin on March 4 next year.
The Attorney General had filed a case before the Colombo High Court against former minister Patali Champika Ranawaka under four charges related to a car accident that allegedly took place in the Rajagiriya area in 2016.
This petition was submitted by Patali Champika Ranawaka stating that the judge rejected the initial objections raised by his lawyers that the case could not be handed over and continued.
The petition has pointed out that this decision of the High Court Judge is against the law.Therefore, the Appeal Court was requested to issue an interim order to stay the High Court
proceedings. It was also requested that the court acquit him of the related charges.
On the advice of attorney Sanjeewa Kaluarachchi, President’s Counsel Faisz Mustapha and Counsel Gamini Panditharatne represented Ranawaka.
Deputy Solicitor General Dilan Ratnayake appeared on behalf of the Attorney General.
