Court issues injunction against Wijeyadasa, Udawatta’s appointments

The Colombo District Court issued an injunction yesterday against Sri Lanka Freedom Party (SLFP) Chairman Minister Dr. Wijeyadasa Rajapakshe, PC, and its Acting General Secretary Keerthi Udawatta preventing them from working as the SLFP Chairman and General Secretary respectively.

Colombo District Judge Sandun Vithana issued the order after considering a petition filed by SLFP Acting General Secretary MP Duminda Dissanayake seeking an injunction preventing them from disrupting the functions of SLFP Acting Chairman Minister Nimal Siripala de Silva and SLFP Acting General Secretary Duminda Dissanayake.

On a previous occasion, the Colombo District Court refused to issue an injunction over a petition filed by Duminda Dissanayake, instead upholding the objections raised by President’s Counsel Romesh de Silva, appearing for defendant SLFP Chairman Minister Wijeyadasa Rajapakshe.

Delivering the order, the Colombo District Judge pointed out that the plaintiff has the opportunity to amend the plaint and confirm the facts for the relevant injunction and ordered to dismiss the petition.

The plaintiff has filed an amended petition before the Colombo District Court and the injunction was issued when the amended petition was taken up before the Court yesterday.

Following that, the petition was fixed for June 3 by the Colombo District Court.

The petition emphasises that although the respondents had appointed Wijeyadasa Rajapakshe as the SLFP Chairman at a meeting which was called “a meeting of the Executive Council of the SLFP”, on May 12, that meeting was not a legal and valid meeting.

In his petition, the petitioner sought from the Court to issue an order preventing others from interfering with the functioning of petitioner Duminda Dissanayake, who is the Acting General Secretary of the SLFP, and an interim restraining order preventing the decisions taken at the so-called meeting in which second defendant Wijeyadasa Rajapakshe was appointed as the Chairman of the SLFP and third defendant Keerthi Udawatta was appointed as the Acting General Secretary of the SLFP.

The petition was filed by SLFP General Secretary Duminda Dissanayake and the petition has cited SLFP Deputy Chief Secretary Sarath Ekanayake, SLFP Chairman Minister Dr. Wijeyadasa Rajapakshe, SLFP Acting General Secretary Keerthi Udawatta, SLFP Acting Chairman Minister Nimal Siripala de Silva and SLFP Senior Deputy Chairman Minister Mahinda Amaraweera as the respondents.

Meanwhile, another case was filed in the Colombo Civil Appellate High Court by Minister Dr. Wijeyadasa Rajapakshe seeking an order that the petition which was rejected, amended and re-filed before the Colombo District Court is illegal.

The case was yesterday taken up before Colombo High Court Judges Frank Gunawardena and Gihan Kulathunga. The case will be taken up again today (21).

President’s Counsel Chandaka Jayasundara appeared for the plaintiff while President’s Counsel Romesh de Silva, President’s Counsel Kuvera De Zoysa, Attorneys Shaheed Barrie and Pulasthi Rupasinghe appeared for the defence.
