Court to give order on prosecution’s additional evidence
The case filed against nine Army intelligence officers in connection with the abduction and murder of journalist Prageeth Ekneligoda was yesterday fixed for order regarding the computer evidence which were added to the additional evidence list by the prosecution, by the Colombo Permanent High Court Trial-at-Bar.
The case was taken up before Colombo High Court Judge Damith Thotawatta. The Colombo High Court Judge stated that presiding Judge of the Colombo High Court Trial-at-Bar panel, Colombo High Court Judge Sanjeewa Morayas had been promoted as a Justice of Court of Appeal and that a new High Court Judge had not been appointed to the vacant position yet. The Colombo High Court Judge also mentioned that other judge of the panel, Colombo High Court Judge Mahesh Weeraman was on official leave.
Accordingly, the case was fixed for further trial on November 23 and the order will be given on that day.
On a previous occasion, the prosecution produced an additional evidence list over the case which they were expected to lead as the evidence.
In that evidence list, eight phone numbers have been added as the new evidence by the prosecution and defence in the case raised objections over the newly added phone numbers to the list stating that it is illegal.
The Attorney General had filed indictments, comprising 17 charges under Section 450(4) of Criminal Procedure Act No. 15 of 1979 as amended by Act No. 21 of 1988 in the High Court against nine Army intelligence officers attached to the Giritale Army camp in connection with the abduction and murder of journalist Prageeth Ekneligoda.
The Attorney General had named Lieutenant Colonel Shammi Arjun Kumararatne, R.M.P.K. Rajapaksa alias Nadan, W.W. Priyantha Dilanjan Upasena alias Suresh, S.M. Ravindra Rupasena alias Ranji, Y.M Chaminda Kumara Abeyratne, S. M. Kanishka Gunaratne, Aiyyasami Balasubramaniyam, D.G.T Prasad Gamage and T.E.R. Pieris as accused in the case on abduction charges.
