The Court of Appeal has terminated consideration of the petition challenging the gazette notification issued by former Sports Minister Roshan Ranasinghe to appoint an interim committee for Sri Lanka Cricket (SLC). The petition was filed by Sri Lanka Cricket Chairman Shammi Silva.
The petition was taken up for before a Bench comprising Court of Appeal Judges Sobitha Rajakaruna and D.N.Samarakoon. President’s Counsel
Kushan de Alwis mentioned that there that the new minister has issued a new gazette in relation to the withdrawal of the gazette notification No 2356/43 on December 12.
However, since some words were entered incorrectly in the gazette notice, he said that a new gazette notice was issued by the Minister of Sports on December 14, correcting those mistakes.
He also mentioned that the Minister of Sports has issued the relevant gazette notification according to the powers assigned by the Sports Act No. 25 of 1973, Sections 31 and 41. Romesh De Silva, PC appearing for the petitioner Shammi Silva, stated that the hearing of this petition can be concluded as the new sports minister has issued a new gazette notice withdrawing this gazette notice.
However he stated that he will not withdraw the relevant petition. Stating that he filed this petition to obtain a ruling that the gazette notice issued by the former sports minister was illegal and unfair, the President’s Counsel stated that he is ready to make more submission regarding this petition
Accordingly, the President’s Counsel asked the court to end this examination with the right to return to the court if necessary. President’s Counsel Uditha Igalahewa who appeared on behalf of former Sports Minister Roshan Ranasinghe also stated that he reserves the right to submit a new petition if the need arises.
The bench allowing the submission made by the two parties decided to close the hearing of the petition.
