Four special petitions filed in SC against CBSL (Amended) Bill

Four special petitions were filed in the Supreme Court yesterday (13) demanding that the “Central Bank of Sri Lanka (Amended) Bill” which has been submitted for Parliamentary approval is against the Constitution. The petitions have been filed by Lieutenant Colonel Anil Amarasekara, Member of Parliament Udaya Gammanpila,   Jehan Hameed and ADB Abeysekara Gunaratne.

The Attorney General has been cited as the respondent in the petitions. It is stated in the petitions that the “Central

Bank of Sri Lanka Amended Bill” has been submitted to amend the Central Bank of Sri Lanka Act and it has been included in the Parliamentary agenda on March 7.

It has been submitted through petitions that the clauses of this Bill are contrary to the provisions of Articles 1, 2, 3, 4 of the Constitution. It is stated in the petitions that the Central Bank of Sri Lanka is an independent institution and neither the Finance Minister nor anyone else has the power to issue orders through their intervention.

The main financial institution of a country should be an independent institution and it is stated in the petitions that the independence of the Central Bank of Sri Lanka will be damaged due to the clauses included in this draft bill and the country may face further financial crisis. Also, the petitions have shown that the sovereignty and territorial integrity of the country will be damaged due to this.
