An accused who was found guilty for breaking into a lodge in Maradana together with three others who were armed, had assaulted and injured its employees and stolen Rs. 75,000, was yesterday sentenced to seven years rigorous imprisonment by the Colombo High Court (CHC).
In addition to the sentence, the accused was ordered to pay a compensation of Rs. 100,000 to the first prosecution witness in addition to a fine of Rs. 5,000, by the CHC.
The case was tried in the absence of the accused under the Section 241 of the Criminal Procedure Code since he had been absconding from Court, while the other three accused pleaded guilty for the charges put before them.
Following a lengthy trial, the judgment was delivered by CHC Judge Namal Balalle and he observed that the prosecution was able to prove the charges against the accused beyond reasonable doubt.
The accused was sentenced to seven years rigorous imprisonment and ordered to pay Rs. 100,000 compensation and a Rs. 5,000 fine by the CHC Judge.
An open warrant was issued to arrest the accused Payagalage Rukman Chaminda as he had been absconding, and the sentencing was ordered to commence following the arrest of the said accused.
