SC puts off LG Polls suspension petition for Feb. 23

The Supreme Court yesterday decided (10) to consider the submissions regarding the writ petition filed by retired Colonel W.M.R. Wijesundara requesting to suspend the Election Commission’s decision to hold Local Government Polls on February 23.

This was decided when this petition was called before the Supreme Court Bench of Justices S. Thureirajah A.H.M.D Nawaz and Shiran Gunaratne.President’s Counsel Saliya Peiris, who appeared on behalf of the respondent Election Commission and its chairman requested that the petition be dismissed without taking it for consideration. He submitted that the retired colonel who has filed the petition has no legal obligation regarding this case.

He also pointed out that the general secretaries or candidates of the parties that have submitted nominations for the Local Government elections have not been named as respondents in the petition.Additional Solicitor General Nerin Pulle, who appeared for the Attorney General, stated that since the country is currently facing a severe economic crisis, the cabinet has decided to give money only for welfare activities including Samurdhi allowance.Senior attorney Faiz Mustapha, who appeared for the petitioner, stated that an amended petition has been submitted in relation to this petition.
