Shani’s petition against PCoI members to be taken up before CA
Former CID Director Shani Abeysekera informed the Court of Appeal yesterday (18) through his lawyer, that the Chairman of the Presidential Commission of Inquiry (PCoI) into Political Victimization, retired Supreme Court Judge Upali Abeyratne and the commissioners have violated an undertaking given to the Courts.
A. Devendra, the lawyer who appeared for the petitioner Shani Abeysekera, stated this when a petition filed complaining that the chairman and members of the commission had ignored the undertakings given before the court and thus should be held for contempt of Court, was taken up.
Ikram Mohammad, PC, who appeared for the respondents, stated that his clients have filed objections against this petition.
He also mentioned that since the petitioner’s lawyer has previously stated that he will not file any objections, the relief requested from those objections can be granted.
Attormey-at-law Devendra, who represented the petitioner, pointed out that the summons issued by the Court of Appeal ordering the respondents to appear before the court is still valid.
Accordingly, the panel of judges considered the facts and decided to refer this petition before the President of the Court of Appeal and the Judge of the Court of Appeal R. Gurusingha. Accordingly, it was decided to call the petition on October 11.
